Terms of Service

1. Acceptance

These Terms of Service ("Terms") govern projects and services provided by 3BTECH ("we," "us," or "our"). No signed contract is required: approving a quotation or paying a deposit constitutes your full acceptance of these Terms.

By accepting a quote you confirm that you are authorized to enter into this agreement and that you will review, provide feedback on, and sign off deliverables within the agreed deadlines.

2. Charges and Quotations

The cost of each project is set out in the quotation we provide. Unless stated otherwise, a quotation remains valid for 14 days from the date of issue. Payments are processed securely via Stripe, in the phases described in the quotation.

3. Payment Terms

• Projects under $10,000 are payable in full before work begins.
• Projects of $10,000 or more require a non-refundable commencement deposit of 40% before work begins, with the remaining balance due on completion.

Final payment is due immediately upon handover (completion), not upon launch.

4. Additional Expenses

You agree to reimburse us for necessary third-party costs incurred on your behalf — such as premium fonts or stock photography — unless we have agreed otherwise in advance.

5. Delays and Rescheduling

Project timelines depend on timely feedback and sign-off. If you are unable to meet a feedback or sign-off deadline, you must notify us within 48 hours. Missed deadlines may affect the schedule and may incur a rescheduling fee.

Both parties commit to the agreed production schedule, except where prevented by events beyond reasonable control (for example, strikes, equipment failure, or other force majeure).

6. Revisions and Amendments

Each development phase includes up to three rounds of feedback. Changes that substantially alter the agreed specification, or that contradict instructions previously given, may incur additional charges.

One final round of amendments is provided before handover. Any design changes requested after sign-off are treated as a separate project and quoted separately.

7. Sign-off and Launch

You are responsible for checking the content and functionality of your website before launch. Changes requested after sign-off are charged at $175 per hour. Note that domain configuration changes can take up to 24 hours to propagate.

Completion refers to handover once the agreed scope is finished; launch refers to the site going live. Final payment falls due at completion, regardless of the launch date.

8. Content and Materials

You agree to designate a single primary contact and to provide all required content (text, images, and other media) within the agreed timeframe. Text should be supplied electronically and images in high-quality digital formats.

If required content is not supplied on time, a surcharge of up to 25% may apply. If materials are not provided within one week of commencement, we may close the project and the remaining balance becomes immediately due.

You are responsible for verifying the accuracy of all copy and claims, for arranging any necessary copyright clearances, and for the accuracy of final proofs.

9. Browser and Device Compatibility

We build websites to work with current, popular web browsers. We cannot guarantee compatibility with every operating system or with future browser versions.

10. Copyright and Ownership

You retain ownership of the materials you provide and grant us the rights necessary to use them in your project. Bespoke designs we create remain our property until final payment is received, at which point ownership transfers to you.

All content on this website, including text, graphics, logos, and designs, is the property of 3BTECH or its licensors and may not be reproduced without our written permission.

11. Confidentiality

Both parties agree to protect confidential information disclosed during the project and not to share it with third parties, except where disclosure is required by law or the information is already in the public domain.

12. Design Credit

We may place a small 3BTECH credit or link in the website footer. You may request its removal in writing. We may also feature the completed website in our portfolio.

13. Domain Names

You are responsible for purchasing and renewing your own domain names. We are happy to provide guidance and to assist with pointing a domain to your website, but we do not purchase domains on your behalf.

14. Indemnity

You agree to indemnify and hold harmless 3BTECH against any claims, damages, or expenses arising from unlawful use of our services or from content you have approved for publication.

15. Liability

To the fullest extent permitted by law, we exclude liability for inaccuracies, omissions, delays, or errors, and for any loss of or damage to materials you supply. Our total liability for any claim will not exceed the fees paid for the service giving rise to that claim.

16. Default

Accounts that remain unpaid 30 days after invoicing are considered in default. We may remove project files from our servers and recover reasonable collection costs, including legal fees.

17. Termination

Either party may terminate the agreement with written notice. On termination, you agree to pay for all work completed up to the termination date within 30 days, and you will receive the completed materials for which you have paid. Commencement deposits are non-refundable.

18. Complaints

If you are unhappy with any aspect of our work, please raise it with your project manager in the first instance. If the matter remains unresolved, it will be escalated to our Business Director. Complaints are documented for six months after project completion.

19. Severability and Amendments

If any provision of these Terms is found to be invalid, the remaining provisions remain in full effect, and the invalid provision will be replaced with a valid alternative of similar intent. These Terms supersede prior representations and may only be modified with the written consent of both parties.

20. Governing Law

These Terms are governed by the laws of the United Kingdom, and any disputes are subject to the exclusive jurisdiction of the UK courts.
